Candidate case for transfer of the monitoring and enforcement of commitments and remedies pursuant to Article 95(2) of the Withdrawal Agreement

By decision C(2012) 2320 of 30 March 2012 based on Article 6(1)(b) in conjunction with Article 6(2) of Council Regulation No 139/2004, the Commission declared the concentration by which the undertaking International Consolidated Airlines Group (‘IAG’, United Kingdom) acquired sole control of the undertaking British Midlands Limited (‘bmi’, United Kingdom) compatible with the internal market subject to conditions and obligations (the ‘Commitments’).

The Commission has come to the preliminary view that the monitoring and enforcement of the Commitments are suitable to be transferred to the designated national competition authority of the United Kingdom (‘CMA’), pursuant to Article 95(2) of the Withdrawal Agreement (1). However, the final decision on this point is reserved.

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

Observations must reach the Commission not later than 10 days following the date of this publication. The following reference should always be specified:M.6447 – IAG / BMI
