Regulation (EEC) No 3922/91 harmonising technical requirements and administrative procedures in the field of civil aviation

WHAT IS THE AIM OF THE REGULATION?

It introduces uniform EU-wide rules specifying minimum safety and related procedures for commercial passenger and cargo fixed-wing aviation.

KEY POINTS

Application

  • The regulation lays down common technical requirements and administrative procedures in the field of civil aviation safety, covering the operation and maintenance of aircraft as well as the individuals and organisations involved in those tasks.These requirements and procedures apply to all aircraft used by EU operators.
  • EU countries were responsible for ensuring that their Civil Aviation Authorities met the requirements for membership of the Joint Aviation Authorities as specified in the arrangements (JAR before 1 January 1992).
  • Currently, this regulation remains in force because national rules on flight and duty time limitations and rest requirements with regard to air taxi, emergency medical service and single pilot commercial air transport operations by aeroplanes are in force by virtue of its Article 8.

Safety issues

  • EU countries may take immediate action over safety problems concerning a product, a person or a body covered by this regulation, regardless of the above rules.
  • Where safety levels are found to be inadequate or lacking under the common requirements and procedures, the European Commission must make appropriate proposals to remedy the situation.
  • In exceptional circumstances, EU countries may also agree to exceptions from the technical requirements and administrative procedures covered by this regulation, provided they are in line with its safety objectives.

European Union Aviation Safety Agency (EASA)

The Commission will be assisted by the EASA when drafting any amendments to the requirements relating to cabin crew and to flight and duty time limitations.

Repeal

Regulation (EEC) No 3922/91 will be repealed by Regulation (EU) 2018/1139 on common rules in the field of civil aviation and establishing the EASA (see summary).

Repeal will be from the date of application of detailed rules on flight and duty time limitations and rest requirements with regard to air taxi, emergency medical service and single pilot commercial air transport operations which still have to be adopted (see Article 32(1)(a) of Regulation (EU) 2018/1139).

FROM WHEN DOES THE REGULATION APPLY?

It has applied since 1 January 1992.
