One Communications is committed to protecting your personal information in accordance with the Bermuda Personal Information Protection Act (PIPA) and other laws applicable to One Communications and its business.  This Privacy Notice explains how we collect, use, disclose, and protect your personal information.  This Privacy Notice also tells you about the rights and choices you may have under PIPA when it comes to your personal information.  As used in this Privacy Notice, One Communications refers to Logic Communications Ltd. and Bermuda Digital Communications Ltd. (trading collectively as One Communications Ltd. and One and hereafter referred to as “One,” “we,” “our,” or “us”).  The terms “personal information,” “sensitive personal information,” and “use” have the meaning ascribed to them under PIPA.

PLEASE READ THIS PRIVACY NOTICE CAREFULLY TO UNDERSTAND HOW WE USE YOUR PERSONAL INFORMATION.

This Privacy Notice applies when you:

  • Receive or use our products and services
  • Visit our website at https://onecomm.bm/ or any of our other websites that link to this Privacy Notice
  • Visit in person at any of our offices or retail locations
  • Download and use any of our application(s), such as our FibreWire TV App or any other application of ours that links to this Privacy Notice

Some of our products and services may have additional privacy practices that may be described to you in different ways, such as in the separate Terms of Service for One Home Automation and Security.  These additional privacy practices and terms may be found at https://onecomm.bm/legal-policies-notices/.  To the extent there is an overlap between this Privacy Notice and service-specific privacy terms, the service-specific privacy terms or agreement will control with respect to that service.  This Privacy Notice does not form part of your contract (if any) with us and does not confer any contractual rights on you or place any contractual obligations on us.

This Privacy Notice does not apply to non-One Communications products, services, websites, and applications (mobile or television) that you may choose to use or interact with through our products, services, websites and applications.  For example, if you subscribe to a One Communications Internet service, such as our FibreWire service, and visit a news or shopping website, the privacy policy for that website will apply.  If you use one of our platforms to use another company’s streaming service, the privacy policy for that streaming service will apply to information it collects about your activity within that service.   1. HOW WE COLLECT PERSONAL INFORMATION

We may collect personal information from you in the following ways:

  • Directly from you: Information you provide to us through forms, applications, contracts, or other interactions with us
  • Automatically: Data we collect through the services we provide, our websites, our applications, and other digital platforms
  • From Third Parties: Information provided to us by third party service providers, partners, or publicly available sources

Depending on the products and services you receive from us and the applications, websites, and systems you use, we may collect the following information:

  • Contact information, such as your full name, home address, telephone number, and email address
  • Billing information, such as billing address, financial and payment information, and financial transactions information
  • Identification information, used to identify who you are, such as birth date and government issued identification
  • Service information, such as types of service, subscriptions, service activity, device information, IP address, geographic location, and call detail records
  • Analytics and interest information, used to tailor programming, marketing, and advertising
  • Security and safety information, such as CCTV footage when you visit our offices or retail locations or make a payment from one of our payment kiosks
  • Any other information required for our business operations and services

We categorize our Cookies as either Essential, Advertising, Analytics & Customisation or Performance & Functionality.

It is important to us that we use your personal information in a lawful and fair manner. We will only use your information where we have a lawful basis for doing so.   • To facilitate account creation and authentication and otherwise manage user accounts. We may use your information so you can create and log in to your account, as well as keep your account in working order
  • To deliver and facilitate delivery of services to the user. We may use your information to provide you with the requested products and services
  • To respond to user inquiries/offer support to users. We may use your information to respond to your inquiries and solve any potential issues you might have with the requested service

  • To fulfil and manage your orders. We may use your information to fulfil and manage your orders, payments, returns, and exchanges
  • To request feedback. We may use your information when necessary to request feedback and to contact you about your use of our products and services.
  • To send you marketing and promotional communications. We may use the information you send to us for our marketing purposes, if this is in accordance with your marketing preferences; you can opt out of our marketing emails at any time
  • To deliver personalised advertising to you. We may use your information to develop and display personalised content and advertising tailored to your interests, location, and more
  • To protect our services. We may use your information as part of our efforts to keep our products and services safe and secure, including fraud monitoring and prevention
  • To identify usage trends. We may use information about how you use our products and services to better understand how they are being used so we can improve them
  • To determine the effectiveness of our marketing and promotional campaigns. We may use your information to better understand how to provide marketing and promotional campaigns that are most relevant to you
  • To respond to an emergency. We may use your information when necessary to respond to an emergency that threatens the life, health or security of an individual or the public
  • To comply with legal and regulatory requirements. We may use your information when necessary to meet our legal and regulatory obligations
  1. SHARING YOUR PERSONAL INFORMATION

We share personal information with others when it is needed to provide you with our products and services. We also share personal information with others:

  • When you direct us to do so, including to fulfil orders of third-party products and services that you purchase through use and to authorize other users on your account
  • When required by law or to respond to legal process such as a subpoena or warrant
  • To protect our property and rights or the safety of our employees, our customers, or other individuals
  • If we enter into a potential or actual merger, acquisition, or sale of all or a portion of our assets, then personal information about you and your subscription will, in most cases, be shared or transferred as part of the transaction

We may share your personal information with:

  • Service Providers: Companies, including our affiliates, who help us operate our business, such as payment processors, IT and professional services providers, or customer support services
  • Business Partners: When necessary to fulfil joint services or initiatives
  • Legal Authorities: Where required by law or compliance with legal obligations
  • We may share your information with our affiliates, including our parent company and any subsidiaries, or other companies that we control or that are under common control with us
  • Others: With your consent or as otherwise authorized by PIPA

These third parties may include, for example:  WeSolveCX, our affiliate who provides customer support services; Microsoft Corporation and Amazon Web Services who provide data storage services; and Emida Technologies for top-ups of pre-paid wireless services.

International Transfers.  We may transfer personal information outside of Bermuda to our service providers and affiliates in countries such as Canada, EEA countries, Guyana, Trinidad & Tobago, and the United States of America.  We implement appropriate safeguards to protect your personal information as required by PIPA if we transfer your personal information outside of Bermuda.

  1. RETENTION AND DELETION

We retain personal information only for as long as necessary to fulfil the purposes for which it was collected, or as required by law. Once the information is no longer needed, we securely delete or anonymize it in accordance with applicable laws or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We implement reasonable physical, technical, and organizational measures to protect the personal information we collect from unauthorized access, alteration, disclosure, or destruction.  This includes, as applicable, measures including, but not limited to, access control lists, multi-factor authentication, firewalls, vulnerability scanning, encryption and network authentication.  These measures may vary depending on the type and sensitivity of the information.

Note that electronic transmission over the internet and electronic information storage technology cannot be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information.

Under PIPA, you have the following rights regarding your personal information:

  • Right to request access: You have the right to request access to your personal information and the right to know the purposes for which we hold your personal information and the organisations to whom your information has been shared
  • Right to rectification/correction: You may request that we correct or update inaccurate personal information
  • Right to erasure: You may request that we erase or destroy your personal information where it is no longer relevant for the purposes of its use
  • Right to object or withdraw consent: You may object to the processing of your personal information for purposes of advertising, marketing or public relations, or where the use of that personal information is causing or is likely to cause substantial damage or substantial distress to you or to another individual

Please note that in some circumstances we may not be required to fully comply with your request, for example, if your request jeopardizes the privacy, life or security rights of others, or if it is not required by law.  In those circumstances, we will still respond to notify you of such a decision.
