The following general terms and conditions (as shall be updated from time to time) (hereinafter "Terms of Use") shall govern the contractual relationship regarding use of this Single-Sign-On-Service and any services provided in connection with the same.
1. Contractor, Scope
1.1 The contracting partner, provider and operator of this Single-Sign-On-Service is Red Bull Media House GmbH, Oberst-Lepperdinger-Str. 11-15, A - 5071 Wals near Salzburg, Austria (hereinafter referred to as "We", “Our” or "Us").
2. Our Single-Sign-On-Service, Participating Platforms
2.1 Our Single-Sign-On-Service offers you the possibility, after a one-off registration on one of the Participating Platforms (as defined in section 2.2 of the Terms of Use below), to sign on (log in) to all Participating Platforms using single access data (i.e. without going through a separate registration and log-in process every time). After successfully registering for Our Single-Sign-On-Service you can log in on each Participating Platform with your access information. Moreover, if already logged in to one of the Participating Platforms, you can immediately use all other Participating Platforms without additional log-in procedures (subject to the respective platform requiring further declarations). Thus, you receive a single identity via which the Participating Platforms can identify and verify you.
2.2 The Participating Platforms are exclusively websites and apps operated by different companies of the Red Bull group around the world. The respective Participating Platforms may have their own user terms and conditions that will be made available on the respective Platform and may apply independently of these Terms of Use for the respective content of the Participating Platforms.
2.3 You can also visit certain of the Participating Platforms without the need to register or to login. However, registration or login by way of the Single-Sign-On may be required if you wish to use certain special features of the respective Participating Platforms.
2.4 The use of our Single-Sign-On-Service is provided free of charge.
3. Registration, User Agreement
3.1 For the use of Our Single-Sign-On-Service, you must register. Registration as a user is only allowed if you are at least 16 years old, You shall be required to provide correct and complete information. If parental consent for registration is required due to local applicable laws you hereby confirm, that you have obtained the necessary consent from your parent/legal guardian. You can set up only one (1) user account per person. Registration can be done via certain social media networks including Facebook and Twitter.
3.2 The login data you create during the registration process is intended solely for your personal use and should be kept secret and safe. You are not permitted to share your login details with third parties to allow them to use the Single-Sign-On-Service via your login, or to disclose your login details otherwise. You are obliged to inform Us immediately on becoming aware of and/or suspecting a case of any unauthorized use, disclosure and / or misuse of your access information or of your user account.
3.3 If you register to this Single-Sign-On-Service from Germany, Our confirmation email to you after your submission of the registration form represents Our offer to conclude a contract for this Single-Sign-On-Service in accordance with these Terms of Use (the “User Agreement”). The User Agreement is only concluded, when you click the confirmation link next to your name and password included in Our confirmation email.
If you register to this Single-Sign-On-Service from anywhere else in the world, the User Agreement is concluded by Our activation of your account after your submission of the registration form as form of Our acceptance of your offer.
3.4 We are entitled to reject the registration of individual users without giving further reasons.
3.5 By registering, you guarantee that the data submitted by you in relation to your account (and any other information that is otherwise provided by you to Us) is in all respects complete, true, accurate and not misleading. Any changes to your data should be promptly updated in your account.
4. Blocking the user account
Without prejudice to Clause 5, we have the right to terminate and/or to limit your access to your account or your access to the Single-Sign-On-Service at any time (whether temporarily or permanently) without prior notice and at our discretion having considered the respective interests of the individual case.
5. Termination of User Agreement
5.1 The User Agreement is concluded for an indefinite period of time. You, and We are entitled to terminate the User Agreement ordinarily, you at any time without prior notice - e.g. by deleting your account - and We may terminate the User Agreement within a reasonable period by a declaration in text form. The right of termination for good cause remains unaffected hereby.
5.2 All limitations of liability and indemnities in these Terms of Use shall apply even after the termination of the User Agreement.
5.3 We have the right, in particular for good cause and without prior notice, to terminate the User Agreement if you violate fundamental rules or repeatedly violates these Terms of Use and / or the terms and conditions of a Participating Platform. This is particularly the case if you have provided false information during or after the registration and / or access information (especially the password) has been disclosed or shared in violation with these Terms of Use. In this case re-registration by you is permitted only with Our prior written consent.
6. Changes to Terms of Use
6.1 We reserve the right to revise and to modify these Terms of Use occasionally, and without provision of reason. We will inform you in reasonable time of these changes, for example by notifying you on your next login over our Single-Sign-On-Service. The changes shall be deemed accepted by you if no objection to them is raised by you within 30 days after the first notification in text form.
We will inform you of the possibility of objecting, the deadline and the consequences of your inaction at the time We notify you of the changes.
6.2 In the event of your objection both We and you are entitled to terminate the User Agreement with immediate effect.
7. Indemnification
You will fully indemnify and hold Us, our affiliates, employees and authorized representatives harmless in respect of all liabilities, damages, claims, actions, expenses, claims or costs (including the cost of legal advice and litigation) incurred, from or in connection with (i) your use of Our Single-Sign-On-Service, (ii) the data provided by you, or (iii) actual or suspected infringements or violations by you of these Terms of Use.
8. Limitation of Liability of Red Bull Media House
8.1 Unless otherwise provided in these Terms of Use, We are liable for a breach of contractual and non-contractual obligations in accordance with the statutory provisions.
8.2 We are liable for damages - for whatever legal reason, and including the liability for legal representatives or vicarious agents, in case of intent and gross negligence. Due to ordinary negligence, we are liable only
(a) for damages arising from the injury of life, body or health,
(b) for damages arising from the breach of an essential contractual obligation (an obligation, the fulfilment of which makes the proper execution of the contract and compliance to which the contractual partner regularly trusts and may rely); in this case, our liability is limited to the reimbursement of the foreseeable, typically occurring damage however.
8.3 The limitations of liability resulting from the previous paragraph do not apply if we maliciously concealed a defect or have given a guarantee for the quality of the goods. The same applies to your claims under the Product Liability Act.
8.4 Without prejudice to the foregoing clauses our liability for defects, failures or delays in the context of access to or the operation of the Single-Sign-On-Service is excluded.
9. Data Protection
The protection of your personal data in the context of all services provided by Us is very important to Us. Our Data Privacy Policy can be found here.
In addition, furthermore, the general privacy statements of each Participating Platform, which are available on the relevant website, apply.
10. Severability
Each provision of these Terms of Use shall be interpreted separately and independently. Should any provision of these Terms of Use be completely or partially invalid or unenforceable, the effectiveness of such provision shall not affect the remainder of these Terms of Use.
11. Governing Law and Jurisdiction
All contracts which are concluded with Us are governed by Austrian law to the exclusion of Austrian conflicts of law and all international and supranational legal systems, in particular the UN Sales Convention (CISG, the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980).
All disputes arising out of or in connection with the Single-Sign-On-Service and these Terms of Use, including in relation to the existence, validity or termination of these Terms of Use, shall be exclusively settled by the competent commercial court in Vienna's First District.
