In 2000, the citizens of California passed Proposition 22, which affirmed a legal understanding that marriage was a union between one man and one woman. In 2008, the California Supreme Court held that the California Constitution required the term “marriage” to include the union of same-sex couples and invalidated Proposition 22.

At a school-supervised event, Joseph Frederick held up a banner with the message "Bong Hits 4 Jesus", a slang reference to marijuana smoking. For the first time in 70 years, the Court heard a case regarding the central meaning of the Second Amendment and its relation to gun control laws. The new policy continued to admit all in-state students who graduated in the top ten percent of their high school classes.
