Terms of Use of Browser Update Constructor Service

1. General provisions

1.1. YANDEX LLC (hereinafter “Yandex”) offers hereby to the Internet User its Browser Update Constructor Service (hereinafter “Service") accessible at: https://tech.yandex.com/browser/constructor and https://tech.yandex.com/browser/apiconstructor by the rules and within the scope of these Terms.

1.2. Regarding all matters not covered hereby, the relations between Yandex and the User connected with use of the Service shall be governed by the User’s Yandex Services Agreement (https://yandex.com/legal/rules), and by the Privacy Policy (https://yandex.com/legal/confidential).

1.3. For the purposes hereof, the User means a person using the Service and being an Internet site owner, that is, a person independently and at its own discretion determining the procedure of use of the User’s site, including the procedure of information layout and functional content of such site.

1.4. The Service offers to the User (site owner) an opportunity to design a code that allows giving the User’s site visitors notices of their browsers outdating with links to last versions of such browsers, and receive such code for embedding within the User’s site.

1.5. When starting to use Service / its separate functions, the User is considered having accepted these Terms, and also provisions of all documents referred to herein, in full, without any limitations and exceptions. Should the User disagree with any provision of such documents, the User has no right to use the Service.

1.6. The Service is provided by Yandex on an “as is” basis. The User shall estimate risks and bear all liability for actions connected to use of the Service by its own. Yandex does not guarantee conformity of the Service to the purposes and expectations of the User, and uninterrupted and correct work of the Service. Yandex may introduce any amendments to the structure and work algorithms of the Service, interrupt its operation or operation of its functions, change or stop performing functions of the Service without preliminary notice to the User and without its consent thereto.

2. Use of the Service

2.1. The Service is accessible to the User upon accomplishing by the latter of the list of actions offered by Yandex and accessible at: https://tech.yandex.com/browser/constructor и https://tech.yandex.com/browser/apiconstructor.

The User may choose the values contained in the block designer and receive a code for embedding within the User’s site.

Yandex proposes the User to execute the specified list of actions, but is not responsible neither for serviceability of the User’s site, nor for failures in the site operation caused by such actions or subsequent use of the Service. The User shall independently estimate and bear all risks connected to such adjustment or subsequent use of the Service.

2.2. In case of successful embedding the Service code within the User’s site, visitors of the User’s site will be automatically notified of outdating their browser versions.

3. The right to collect statistical data

3.1. The User understands and agrees that, from the moment specified in clause 2.2. hereof, the code will collect anonymous and depersonalized statistical data (without binding to personal data of the User’s site visitors) of visiting the User’s site, as well as anonymous and depersonalized data of the User’s site, and automatically transmit them to Yandex for safekeeping of the generalized statistical information accessible to Yandex for further use for its own purposes. Such statistical information shall be neither accessible to the User, nor disclosed to third parties.

3.2. Yandex cannot guarantee that embedding the Service code within the User’s site, collection, transmitting to Yandex and safekeeping by Yandex of the information specified in clause 3.1 will not break the law of the User’s location. The User shall use the Service at its own risk, and is solely liable to visitors of the User’s site for all actions connected to use of the Service.

3.3. Yandex represents that the Service does not perform collection, transmitting to Yandex and safekeeping by Yandex of the data referred to personal information by the laws of the Russian Federation.

4. Final provisions

4.1. These Terms may be changed by Yandex without any special notice, and a new version of the Terms shall come into force upon its placement in the Internet at the url specified in this clause, if not otherwise stipulated in a new version of the Terms. The current version of the Terms is permanently accessible at: https://yandex.com/legal/updater_termsofuse. In case if Yandex introduces in these Terms any changes the User disagrees with, the latter will be obliged to stop use of the Service.

4.2. All wishes, remarks, requirements and claims connected to the Service work shall be submitted through the feedback form at: browser-constructor@support.yandex.ru.

4.3. Regardless of the User’s location and location of the equipment where the User’s site or domain zone of the User’s site is placed, the Service use relations shall be governed by the laws of the Russian Federation. All disputes and dissents arising from use of the Service shall be resolved by a competent court at the location of Yandex, and the Russian version of the text hereof permanently accessible at: https://yandex.ru/legal/updater_termsofuse shall prevail over versions in other languages.
